  Chapter 1 General Principles

  Rule 1This regulation is hereby established in accordance withゞThe Regulations of Prison’s Educational Reform Work〃,ゞThe Compendium of Educational Reform for Inmates〃of the Justice Department, and in combination with the practicality of Shanghai Prisons as well as juvenile delinquent correction centre, to strengthen the orientation for new inmates, correctly enforce punishments and implement reform, promote security and stability of supervision, and enhance the quality of educational reform.

  Rule 2 Orientation for new inmates is the first working procedure and essential basis of education for prison to enforce punishments and educational reform. Through the orientation for new inmates, the prison aims to direct them to clearly understand their rights and obligations, familiarize them with the rules and regulations of the prison, master the general knowledge of serving sentence, acknowledge and repent for their crimes, cultivate correct behavior, adjust psychological emotion, participate in labor training, to enable them to establish identity consciousness, define reform objectives, adapt to prison life, and through carrying out pertinent and intentional investigation and evaluation to formulate inmates’individual rectification pamphlet to put forward detention suggestions and rectification programs for follow-up reformation.

  Rule 3 Orientation for new inmates has to insist on combining strict management with intensification of education, combining basic education with behavior cultivation education, combining group education with individual rectification, as well as combining the promotion of mental transform with initiating self confession and reporting others’offends.

  Rule 4 New inmates with remaining sentence of longer than 1 year should be centralized to accept a 2-monthperiod of orientation. Those with remaining sentence of shorter than 1 year should be centralized to accept a 2-week period of orientation. The orientation for adult male inmates (except foreign inmates) is carried out by Prison for New Inmates,The orientation for female inmates and juvenile delinquents are carried out by female prison and juvenile delinquent correction centre respectively. Various other prisons should consider their own practicality and carry out a 1-week orientation for the newly arriving inmates.

  Chapter 2 Contents of Orientation for New Inmates

  Rule 5 The main content of orientation for new inmates includes: Education on common Knowledge for serving sentence, education on acknowledgement and repentance of crime, education on supervision and reform system, education on regulations of reform behavior, education on psychological health and labor skill training, etc.

  Rule 6 Education on common knowledge pertains to the introduction of common knowledge of reformation, including sentence life, hygiene, daily routine, drill, study, labor, cultural activities, communication and visitation through specific and objective explanatory lessons, and to introduce the ways and means of lodging a complaint or reflecting a situation, telling new inmates about the easily encountered problems in their reform life, directs them to adapt to the reform life as soon as possible and as smoothly as possible. The essential points of education on common knowledge include:

  (1) Education on ゞPrison Law〃. To disseminate the guidelines and policies of the prison administration, nature and role of the prison organization, legal status of the prison police officers, legal status and reform requirements of the inmates, and to direct inmates to correctly understand the prison and deal properly with various relationship within the prison.

  (2) Education on the rights and obligations of inmates. To distribute ゞRights and Obligations Notification〃to inmates, informing them of the rights they enjoy and the obligations they have to fulfill during their sentence, and the correct ways and means to protect their rights, and to ascertain the relationship between the protection of rights and the fulfillment of obligations.

  (3) Education on rules and regulations. To disseminate the necessity of adhering to behavioral regulations, to preach the specific content and requirements of inmates’behavioral regulations, to educate inmates to establish the concept and consciousness of adherence to rules and regulations.

  (4) Education on labor production. To disseminate the meanings of labor on reform of inmates, educate inmates to fully understand the important status and effect of labor in their reform; to combine with the practicality, and establish safe production, labor discipline, arts and crafts procedures, maintenance of production facilities, production quality guidelines, work site management, labor protection, etc. and to enhance their labor concept, consciousness on work safety and quality.

  (5) Education on the policy future. To disseminate the related policies of self confession and reporting others’offends, initiate new inmates to confess their remaining crimes, report accomplice or other people’s criminal activities; to preach the criminal law, law of criminal appeal, the regulations of the prison law relating to sentence reduction, parole and to severely frustrate criminal activities within prison, and to apply the positive as well as the negative aspects of the classic cases to direct inmates to develop a positive reform confidence and determination.

  The education on common knowledge should take into account inmates’actual mental situation, prepare for lesson seriously, and executes the lesson plan systematically, clearly illustrates the principle, removes doubts and inspires confidence. The education should be carried out in the form of placing emphasis on class room lessons, and be combined with other ancillary forms of education such as special topic discussion, using one’s own experience to advise others and scene simulation training, etc.

  Rule 7 Acknowledgement and repentance of crime refers to using education to enable inmates to realize the importance of acknowledging their crimes and accepting the judgment given by the court, and gradually be able to achieve awareness of crime, acknowledgement of crime, repentance of crime and atonement of crime. The essential points of education on acknowledgement and repentance of crime include:

  (1) To organize and carry out education on legal system and morality, it subdivides into 4 aspects of education, including “acknowledging the facts of crime, accepting court’s judgment, recognizing the harms of crime and excavating the cause of crime”.

  (2) Using various form of education to organize inmates to carry out activities such as “acknowledgement and repentance of crime reform promise”, “accusation of crime”, “excavation of the cause of crime, reckoning of the harms of crime”, “remonstration education by relatives”to strengthen the effects of classroom education.

  (3) To organize new inmates to prepare materials of “3 histories”, namely, acknowledgement of crime and criminal history, history of growing up, and history of reformation in writing.

  Education on acknowledgement and repentance of crime has to aim at inmates’reform attitude, system organization, to provide education by categorization, and to let them understand the reason, to criticize their mistakes and to rectify the consciousness. It should be carried out base on classroom education, and be combined with various other ancillary educational activities such as individual, group and social educations, etc.

  Rule 8 Education on supervision and reform system refers to organizing inmates to study and master various system requirements of prison administration which are closely related to their own reform life, so that they will be able to accept and take their reform properly, establish reform confidence, ascertain reform objectives, actively and steadfastly carry out reform. The essential points of education on supervision and reform system include:

  (1) To organize the study of ゞInstruction of serving sentence handbook〃distributed by Shanghai Prison Administration Bureau.

  (2) To disseminate more intensely about the basic supervisory systems such as methods of inmates’point evaluation, grading management, rewards and punishments, educational reform, labor production, psychological rectification, living hygiene, etc.

  Education on supervision and reform system should base on individual differences of inmates’reform situations, and carry out different organizational demarcation, study by category, emphasize on key points, and strengthen the operational aspect. It should be carried out in the form of classroom education, and be combined with other ancillary forms of education such as self study and recitation, special topic discussion and written test, etc.

  Rule 9 Education on regulations of reform behavior pertains to the education on the regulation of the daily behavior in order to strengthen inmates’consciousness of identity, punishment and discipline, regulate their behavior, enable them to master skill required for serving sentence and enhance their ability to adapt. The essential points of education on regulations of reform behavior include:

  (1) Systematically explain the content of number 88 order of the Justice DepartmentゞInmates’Behavioral regulations〃, organize inmates to study the regulations rule by rule, be proficient and able to recite the regulations, to strengthen their consciousness on behavior.

  (2) To organize inmates to learn and master reform basic movement techniques such as alignment drill, quilt folding drill, callisthenic, wooden tool drill, etc.

  Education on regulations of reform behavior should aim at achieving propriety and understand the regulations, and should establish centralized training for all members, categorize them base on differences of age and physical conditions of each individual to carry out training and to strengthens the cultivation of inmates’behavioral regulation. It should be carried out by placing emphasis on behavioral training, and be combined with other forms of trainings such as classroom lesson and centralized training evaluation, etc.

  Rule 10 Education on psychological health includes calculated, organized, systematic popularization of knowledge of psychological health and methods of psychological adjustment for inmates. Maintaining and promoting the development of psychological health is an important component of education for new inmates. The essential points of education on psychological health include:

  (1) To develop psychological test, crisis intervention and psychological treatment pertaining to targeted individuals, and to set up inmates’psychological health records.

  (2) To impart the basic technique of psychological adjustment, help inmates to adjust their psychological emotion reasonably, deal with various interpersonal relationships properly and adapt to prison environment as soon as possible.

  Education on psychological health has to rely on the psychological health instruction centre to fully exert the functionality of psychological treatment, and help inmates to adjust their reform attitude, stabilize their reform mood, to achieve role transformation, and adapt to the prison environment. It has to be based on psychological test, and be combined with other ancillary forms of education such as classroom lesson, conversational consultation, crisis intervention, etc.

  Rule 11Labor skill training refers to systematically arranging inmates to carry out adaptive labor training to rectify their working attitude, strengthen work discipline, improve work attainment and master labor skill. The essential points of labor skill training include:

  (1) To organize inmates to carry out adaptive labor training, familiarize them with prison working environment and requirements.

  (2) To review inmates’working attitude, work discipline and work attainment, etc.

  Labor skill training has to combine with the practicality of the prison, and systematically carry out group training, strengthen inmates’work consciousness, cultivate working regulation and discipline. It should emphasize on group labor training and be carried out in combination with other ancillary forms of education such as comment and appraisal education and individual conversational education, etc.

  Chapter 3 Investigation and Evaluation of Orientation for New Inmates

  Rule 12 Investigation and evaluation for new inmates refer to carrying out pertinent and intentional investigation and evaluation of individuals to ascertain the degrees of danger, degrees of difficulty of reforming and the reform requirements of inmates, and to formulate ゞinmates’individual rectification pamphlet〃hereinafter calledゞpamphlet〃, for the purpose of putting forward detention suggestions and rectification programs for follow-up reformation.

  Rule 13 Investigation for new inmates refers to surrounding the objective of transforming inmates to become a “law abiding citizen”, systematically collect and sort out all types of information pertaining to the basic condition, criminal environment and reform requirements of new individual inmates, and use these information as the basis of evaluation, diversion and reformation.

  (1) Content of investigation: circumstances of crime, mental development, individual diathesis, character and psychology, family condition, social skill, cultural expertise, etc.

  (2) Methods of investigation: refers to record materials, face to face interview, questionnaire, survey and observational investigations.

  (3) Tools of investigation: basic condition verification form, investigation questionnaire for inmates and their families, inmates’conversation circumstantialities form, psychological test measure form, cultural level test, etc.

  Rule 14 Evaluation for new inmates refers to carrying out analysis on the investigated information of inmates, and base on the corresponding evaluation standard, to ascertain and differentiate the degrees of danger, degrees of difficulty of reforming and reform requirements of individual inmates.

  (1) Inmates’degrees of danger evaluation should be based upon the safety requirements within the prison, and begins with the investigation of 3 items, namely the prevention of escape, the prevention of suicide and self-inflicted injury, and the prevention of events of malignant nature or events with substantial repercussion.

  (2) Inmates’degrees of difficulty evaluation should be based upon knowing inmates from scientific perspective, to carry out evaluation from 4 dimensions, namely, inmates’cognitive level, subjective wickedness, social environment, and actual performance:

  (3) Inmates reform requirements should be based upon the practicality of prison work and the requirements of inmates’return to society, and to carry out evaluation from 7 required items, namely, strengthening inmates’cultural knowledge, law awareness, employment skill, morality, mental and physical health, social support and adaptability.

  Rule 15 After carrying out evaluation and appraisal for inmates, it is necessary to ascertain the rectification objectives, items and measures for inmates and put forward detention and rectification recommendations, to register and formulate ゞpamphlet〃.ゞpamphlet〃is the basis on which the reform on inmates is depended upon and it is an important content of the educational rectification mechanism. The rectification objectives, items and measures put forward byゞpamphlet〃is the instructional requirement for prison’s educational reform.

  Rule 16 Aゞpamphlet〃should be prepared for each of the inmates who receives centralized orientation program for new inmates. When inmates are detained and diverted, the ゞpamphlet〃, together with the original materials of related investigation, should be transferred in the form of a consolidated document or after being placed into inmates’reform record file, and be followed by registration procedure of transfer. Accepting prisons have to carry out measures and fulfill their responsibilities, base on ゞpamphlet〃management and application regulations. The prisons also have to carry out a supplementary modification on the conditions such as degree of danger, degree of difficult in reforming, and rectification items, etc. within 6 months of the transfer of inmates, and carry out a situation evaluation 1 year after the transfer, base on the implementation methods of inmates’individual investigation.

  Rule 17 Within 3 working of inmates’arrival at the prison, police officer in charge should engage in a general conversation with inmates individually, to understand and get hold of inmates’basic situation and to stabilize their mental emotion. Inmates who are extremely pessimistic emotionally, who refuse to admit their crimes and accept their judgment, or who may be hiding their remaining crimes should be listed as important targets. Establish individual’s educational record file, to achieve encircling and converging control, strengthen help and guidance provided by volunteers, and to properly accomplish the transfer of inmates’situation after the completion of the orientation program for new inmates.

  Chapter 4 Administration of Orientation for New Inmates

  Rule 18 Prison’s Education and Reform Division is responsible for organizing, convening and implementing orientation program for new inmates. Female prisons and juvenile delinquents correction centre should establish Education and Study Group, and appoint specific police officer to implement and specially responsible for organizing and implementing orientation program for new inmates. Prison has to perfect the management network for orientation program, to ascertain the job responsibility mechanism, to instruct and supervise each brigade to carry out various orientation programs for new inmates. Prisons for new inmates, female prisons and juvenile delinquents correction centre should establish special unit or organize special group of personnel to carry out individual investigation and evaluation for new inmates.

  Rule 19 Prisons for new inmates, female prisons and juvenile delinquents correction centre should establish implement methods for orientation programs for new inmates, set up education plan, course arrangements and classroom lecture notes, schoolwork system, establish implementation methods of individual inmates’investigation and evaluation system for new inmates, carry out various tasks under the orientation program for new inmates, timely collect and sort out various information, properly maintain an updated record of the progress of orientation for new inmates, summarize experience seriously, advance the functions of individualized rectification in terms of scale, intensity and information. Each prison should establish a management and application regulation for ゞIndividualized rectification pamphlet for inmates〃.

  Rule 20 The total time for accepting centralized orientation program should not be less than 400 hours including no less than 100 hours of class lesson, of which, education on common Knowledge for serving sentence should not be less than 60 hours, and education on acknowledgement and repentance of crime, education on supervision and reform system, education on regulations of reform behavior, education on psychological health and labor skill training, should not be less than 10 hours; time of ancillary education, including education on individuals should not be less than 50 hours, training hour on behavior should not be less than100 hours; training hour on labor education should not exceed 150 hours.

  Rule 21 Prison for new inmates, female prison and juvenile delinquent correction centre should organize a group of classroom teaching instructors for orientation program for new inmates, and to strengthen the training and development of the teaching group, as well as developing the ancillary educational audiovisual database that suits the inmates’peculiarity needs. Teaching group should conduct class lessons according to the education arrangements, seriously carry out study and research activities, and to improve the quality of teaching.

  Rule 22 Orientation for new inmates should insist on the direct management by the police office in charge, who should be responsible for the related educational activities such as mobilization, organization, training, oral comment and appraisal, writing comments on documents submitted, gathering of information, and feedback, etc. the police office in charge should move into cell-room to understand get hold of the study situation of every new inmate in a timely manner, and to strengthen the guidance.

  Rule 23 Adhere to the mental development analytical system. The police officer in charge should gather inmates’feelings on a daily basis within the first 5 days of new inmates’arrival at the prison and submit report to the brigade. New inmates who do not acknowledge their crimes, the investigation of whose identities are pending, who may be hiding remaining crimes or clues of crimes, and who have dangerous tendency are to be taken as important targets during the period of their arrival. The police officer in charge should carry out proper guidance for them to coordinate with the prison administration department and put the circumstances of education on record.

  Rule 24 To place emphasis on the effect the relatives play in transforming inmates through education, make use of the opportunity of the first visitation, strengthen the publicity for inmates’relatives, eliminate the doubts of inmates’relatives, fully excavate inmates’relatives educational resources, expand activities of voluntary help by relatives, establish education mechanism involving interaction among prison, inmates and relatives, regulate and enrich the ways and means of remonstration by relatives, to assist and facilitate the mental transformation of inmates.

  Chapter 5 Evaluation of Orientation for New Inmates

  Rule 25 The orientation program for new inmates is implemented, examined and accepted through grade evaluation. The relevant operational department of the Prison Bureau carries out evaluation to examine and accept the results of orientation work for new inmates in the prison for new inmates, female prison and juvenile delinquent correction centre once every 6 months, while the prison for new inmates, female prison and juvenile delinquent correction centre carry out evaluation to examine and accept the results of orientation work for every batch of new inmates

  Rule 26 New inmates are to write a summary report on orientation program according to requirement. The prison should conduct a written test for new inmates on their education on common knowledge of serving sentence, and to carry out evaluation and appraisal of the conditions of their orientation program, behavioral regulations, trainings on alignment movement and domestic business, etc. and to put the results on record. For those whose fail their evaluation, the orientation program should be extended for a period of 1 month.

  Chapter 6 Supplementary Articles

  Rule 27 The interpretation of this regulation is the responsibility of the Shanghai Prison Administration Bureau.

  Rule 28 The effective period of this regulation is 5 years, from 2012 July 1st to 2017 June 30th. The original ゞWorking Regulations of Orientation for New Inmates 〃that was implemented on 2008 June 1st (Shanghai Prison Department Educational Reform _2008ヽNo.10)is hereby repealed.
