Shanghai Prison Bureau Inmates¨ outgoing Education Work Regulations Chapter 1 General Principles

  Rule 1 This is set up to strengthen the inmates’outgoing education and reformation results, raise the quality level of reformation according to Justice Department’s ゞPrison Educational Reform Work Regulations〃 and ゞInmates’Educational Reform Work Program〃as well as Central Committee ゞSuggestions Concerning Further Steps to Strengthen the Release of Inmates Upon Completion of Prison Term and Emplacement〃

  Rule 2 The main point of outgoing education is for inmates’to adapt to society upon their completion of prison terms, this is an important stage of the education reform work. Prison education is to enable inmates to have an understanding of the environment, economic progress and the job market.

  Rule 3 The outgoing education combined with self regulation summarize the strengthening of education and returning to society education in a systematic way together with guidance for employment opportunities, prison internal education and assistance for returning to society

  Rule 4 Inmates who are due to complete their prison terms will undergo this education program. Inmates who have more than 1 year remaining sentence will be trained for 3 months: Inmates who have less than 1 year remaining sentence will be trained for 2 weeks. Inmates who are waiting for reduction, parole or release should follow their training according to the Prison Warden’s Meeting Discussion.

  CHAPTER 2 CONTENTS OF OUTGOING EDUCATION

  Rule 5 The main contents of the outgoing education comprise the summary of reformation, citizen law compliance guide, employment placement guide and returning to society guide.

  Rule 6 The main point of the summary of reformation is to guide the inmates to recall the areas of inadequacies in their life and to help them differentiate between right from wrong thereby achieving better results. Inmates are to reflect on themselves according to the actual reformation, legal viewpoints, attitude changes, adherence to rules and regulations, cultural and technical skills in order to provide a summary report on their reformation. In order to have an attitude change, assessment and analysis on the overall reformation performance are made to confirm the results and to highlight the areas of weaknesses so as to raise the level of adherence to laws, seriousness in learning and labor work.

  Rule 7 The main point of the citizen law compliance is to impart correct information on the current situation of the society, inmates’general knowledge the law having a deeper understanding “Law Abiding Citizen”and “Correct Philosophy of Life”so as to help inmates to have a properunderstanding of self respect, self reliance which will include the following important points:

  (1) Situation of Society. This portion introduces the changes in society, development, law and order, employment opportunities, social security, help inmates to raise the level of understanding, build confidence, prepare inmates to return to normal life, guide inmates how to look for jobs and plan their new lives ahead.

  (2) Adherence to Laws. This portion allow inmates to learn the common law, morals, work ethics, family virtues so as to build correct understanding of legal and family values, seeking legal assistance or other avenues of help, learning to follow rights and obligations, develop good self awareness and good family relationships and to adapt to thesociety.

  Rule 8 The primary objective of the guidance on employment opportunities is to help inmates to formulate plans to seek for eligible and to prepare themselves for employment back in society. Such education will include:

  (1) Job Skills Training. According to the needs of inmates in seeking for employment together with their actual situation to organize relevant job skills training which are required by the job market so as to enable inmates to secure jobs.

  (2) Employment Policies. To learn national labor laws and employment policies especially regulations concerning job placement for former prisoners so as to assist and direct inmates to secure employment and to build the correct work attitude.

  (3) Job application. Increase inmates’ability to enquire about employment and job selection through classes to guide on employment, job exhibitions and conduct job suitability assessments, job fairs and information regarding labor work and employment in the community, actively encourage inmates to be careful in job selection, increase the success rate of job placement and the chance of securing employment.

  Rule 9 The main purpose of this guide is to help the inmates to adapt to the environment as they will experience difficulties upon returning to society such as lack of knowledge, inability to adapt to the environment, etc。Therefore the training on this area will include:

  (1) Social Security Training. To organize learning regarding healthcare, living conditions, basic insurance, education, elderly care, other social security policies, manner of reporting residence changes, application to seek help, procedures on social security matters so as to obtain basic social security assistance.

  (2) Training on Aftercare Policies. Notify inmates about the procedures concerning rights and obligations upon release, focusing on difficulties that will be encountered by the inmates, organize job selection training, business start up, legal aid, civil administration assistance, community assistance, general knowledge and policies to care for children who are minors, shorten the initial period whereby the inmate is unable to adapt to community upon release. Prior to release of inmate, increase the number of family visits to restore family relationships, keep up with the changes in society and to seek for the correct channel to solve problems.

  (3) Psychological education. This portion deals with the anxiety, tension, inferiority and other psychological issues of inmates that may be developed prior to release, introducing ways to adjust the mindset and how to seek help on psychological matters to enable inmates to exercise control over their state on mind so that this will help to withstand setbacks.

  CHAPTER 3 OUTGOING EDUCATION ASSESSMENT

  Rule 10 Outgoing education assessment is a key stage where inmates’individual progress and activities, education reform effectiveness are checked and analyzed for the entire period of sentence served by inmate to appraise the quality of reform. Prison education assessment group will be set up to continuously improve the checks, assessment mechanism, working towards independent assessment and professional assessment thereby raising the standard of assessment work.

  Rule 11 Outgoing education assessment group wants to operate by referring to inmates’records and particulars, observe, interview, survey questionnaires etc, to fully understand and accurately grasp inmates’individual condition, family and community relationship, performance while serving sentence and inmates’plans for life after release, etc focusing in the assessment is the effectiveness of the education reform and the dangers when returning to society.

  Rule 12 The outgoing education assessment group wants to rectify and implement assessment by completing ゞInmates’Individual Self-Correction Handbook〃in order to rectify, execute condition assessment, and this will act as the basis for prison (division) entire education reform quality assessment program. At the same time, outgoing education assessment group wants to review inmates’period of sentence to assess if inmates have observed the laws and regulations, forecast inmates’adaptability to society and to raise new views regarding the forecast.

  Rule 13 Concerning inmates’assessment results to form ゞInmates’Education Reform Integrated Assessment Report〃, which will mainly cover situation of the education reform completion and compliance with the laws and regulations, adaptability to community, possibility of committing offence again and the specific difficulties that may be encountered upon release, changes in family, unable to find permanent accommodation, interaction with community, danger posed to community, etc. ゞAssessment Report〃should be delivered by normal mail or electronically to the Judicial Administration Department responsible at inmates’original place of residence at least 10 days before release through internet or normal mail.

  Rule 14 Prison to develop evaluation on the quality of education reform on inmates through follow up by telephone calls, letters, seminars and any other follow up methods. Integrated treatment department compiles previous year education reform quality survey results annually, collate and categorize them to indicate the rate of success and failure of the education reform by taking individual cases as a representation as part of the research so as to raise the standard of the integrated evaluation of assessment and quality of education reform on a continuous basis.

  CHAPTER 4 OUTGOING EDUCATION MANAGEMENT

  Rule 15 Every prison should set up a separate unit as a concentration center to detain outgoing inmates and for the education purpose. For inmates from Hong Kong, Macau, Taiwan, foreign inmates, inmates who are sick or having infectious diseases, inmates with mental illnesses or in critical condition, or inmates who practice evil religions, problematic inmates are exempted by the Prison Administration Bureau.

  Rule 16 In order to conduct common classes in prison and to ensure employment, sharing of resources as part of the standardization model for outgoing education in an easy and quick communication way. The first working day before 25th of every month, Wu Jiao Chang Prison will proceed with the detention and education work of Shanghai residents who are below 60 years old and those who are about to be released after verification by Prison Administration.

  Rule 17 Prison should establish plans to implement education classes on law and science, setting up educational plans, establishing classroom handouts and work procedures, recording the work done with respect to education, raising the effectiveness of education.

  Rule 18 Prison should organize lecturers’group to set up audio visual database to provide assistance to meet the special needs of the outgoing inmates, lecturers group should also follow the education schedule to conduct lessons, seriously carrying out study activities so as to continuously raise the standard of teaching.

  Rule 19 The inmates will receive 3 months of outgoing education and the total lessons should not be less than 400 hours of which 100 hours should be classroom-based, and education assistance includes individual inmates’100 hours, labor education will include guidelines on work employment opportunities and 200 hours for skill development. 2 weeks of total outgoing education lessons can be adjusted based on the actual situation.

  Rule 20 To actively deploy community resources, select and invite relevant community departments and personnel to conduct in a systematic manner on policies, education for future plans, education on compliance with laws and regulations and psychological education, continuously striving to enrich program, developing innovative work methods, working hard to explore and form practical work, exhibiting work of outstanding nature in outgoing education program, in order to continuously raise outgoing education work quality.

  Rule 21 Strengthen the education work by allocating linkage and providing constructive suggestions for the local department providing assistance to as a step towards fulfilling connection in the management process, perfecting the linkage mechanism for prison and local departments. Individual educational talks and guidance for those inmates awaiting to be released will be widely carried out as this is an important link with the object of harmonizing. While drafting forecasts, there is a need to follow the regulations concerning the allocation for assistance to household residence provided by local work departments where they will issue “must visit”and “must receive”and notification; and for those intending to take revenge on society, there is a also a need to initiate notification to the relevant law enforcement departments. At the same time, the work should be strengthen by providing individual guidance where inmates’plans to return to community, family relationships and employment plans are fully integrated.

  Rule 22 To actively explore and set up “Big Education Structure”in the outgoing education management system involving daily management, classification of conditions, learning labor work, skill training, innovative ways of working, so as to build favorable environment for inmate to return to society. This is to implement “Strict Mutual Aid” management style, strengthening inmates self discipline: need to have explore outgoing education inmates who are returning to society to experience activities and model as part of actual learning: outgoing education inmates will avoid the labor guideline, The effectiveness of the reform system is the focus on joining labor and the suitability of labor in order to increase the labor remuneration, exercise greater management, education, labor and every work.

  CHAPTER 5 OUTGOING EDUCATION TEST

  Rule 23 Prison should organize the summary of inmates’reformation situation, prepare a report on ゞSummary of Outgoing Education〃to act as a learning for return to society and planning for employment opportunities. As part of the overall inmates’performance, a summary complying to the educational rules and regulations, categorizing into excellent, good, satisfactory and poor grades and recording such grades into ゞInmates’Education Situation Report Card〃.

  Rule 24 Every year the Shanghai Prison Bureau Education Reformation will carry out an assessment and the criteria of the assessment consists of organization management, apportionment of trainers, duration of education, education contents and format, quality of education, etc. The Bureau integrates all necessary office work to strengthen the overall Prison Bureau outgoing education ”Demonstration Points”related for assessment. Every prison reformation department responsible for every batch of outgoing education work shall carry out quarterly assessment on the progress of the outgoing education work.

  CHAPTER 6 ADDITIONAL PRINCIPLES

  Rule 25 Shanghai Prison Bureau has the responsibility to explain this regulation.

  Rule 26 This regulation shall be effective for 5 years commencing 17th October 2012 to 16th October 2017. The original ゞInmates Outgoing Education Work Regulation〃(Shanghai Justice and Prison Education Reform[2010] Number 13 shall be hereby cancelled.
