  Chapter 1 General Principles

  Rule 1 (Objectives and Basis)

  This regulation is hereby established in accordance withゞThe Prison Law of the Republic of China〃, ゞThe Working Regulations of Prison Educational Reform〃ゞThe Compendium of Educational Reform for Inmates〃of the Justice Department, and in combination with the practicality of Shanghai Prisons, to strengthen the cultural education of inmates, help to improve the cultural diathesis of inmates and to enhance the quality of educational reform.

  Rule 2 (Objectives of Mission)

  Base on the difference of inmates’education levels, the prison carries out illiteracy elimination, elementary school, junior high school level cultural education, to ensure inmates who are illiterate to obtain literacy within 2 years of serving sentence, and to achieve higher than 95% rate of obtaining elementary school certificate for those who take part in the cultural education program.

  Prison supports and encourages inmates to take part in senior high school(technical secondary school) education, higher education self study examination and various other cultural education programs.

  Rule 3 (Length of Schooling, Courses and Lesson Hours)

  Length of illiteracy elimination education is 1 year. This education includes anゞAdult literacy〃course with total lesson-hour of 160 hours.

  Length of elementary education is 2 years. This education includes 3 elementary school courses, language, mathematics, and politics. The total lesson-hour is 800 hours.

  Length of junior high school education is 3 years. This education includes 5 junior high school courses, language, mathematics, history, geography and politics. The total lesson-hour is 1,000 hours.

  Chapter 2 Implementation of Cultural Education

  Rule 4 (Targets of Cultural Education)

  Inmates who have not completed the 9-year compulsory education prescribed by the country, age below 45 years old, and who are able to persevere on the normal study, should accept compulsory education.

  (1) Inmates whose education level is illiterate of half illiterate, having served sentence for longer than 1 year (including this number, the same applies hereinafter) should obtain illiteracy elimination certificate; those serving longer than 3 years and 6 months sentence should obtain elementary school certificate.

  (2) Inmates whose education level has not achieved the completion of elementary school, and who are serving sentence of longer than 2 years and 6 months should obtain elementary school certificate.

  (3) Inmates whose education level has not achieved the completion of junior high school should take part in junior high school cultural education to complete the course or obtain graduation certificate.

  Inmates who have completed compulsory education or who are older than 45 years old, should be encouraged to take part in electronic university, correspondence university, higher education self study examination or other forms of study.

  Rule 5 (Affirmation of Targets of Cultural Education)

  The prison should refer to inmates’record seriously and to engage in educational conversation, and compare with the conditions listed in rule 4 of this regulation to affirm the targets of cultural education.

  (1) Age: base on registration form of new inmates on arrival.

  (2) Health condition: inmates with serious chronic diseases, mentally abnormal or retarded, blind, deaf, dumb and are unable to take part in education shall be based on their physical examination report on arrival; and if they are unable to continue their normal study during sentence, there should be a diagnostic proof provided by the prison’s general hospital.

  3Term of sentence in the prison: Counting inmates base on the register as at August 25th of each year, all those who qualify the conditions should be enrolled.

  (4) Education level: base on judgment latter for new inmates. In the event that no education level is indicated in the judgment letter, if inmates are able to provide effective education certificates, the education level can be based on the education certificates provided. Where provision of effective education certificates is impossible, it is necessary to conduct written test to ascertain the education level.

  Rule 6 (Education Level Test)

  To carry out the test to ascertain actual education level for new inmates whose original education level is below junior high school (not completing junior high school).

  The test should adopt the test paper uniformly prepared and distributed by the Prison Administration Bureau.

  Test results should be recorded into ゞInmates’educational Status Record 〃. Each prison should establish it’s special record.

  Rule 7 (Cultural Education)

  Cultural education should adopt the form of classroom education. Participating inmates should take notes during the lessons and complete their classroom work in time. Teachers should check and comment on the schoolwork timely. Educational class should establish ゞEducation logbook〃to record the actual teaching situation.

  Rule 8 (Examination and Issuance of Certificate)

  Prison should organize at least two sub-unit examinations and one mid-term general examination and one final general examination for every semester.

  At the end of June every year, Shanghai’s education Administration Department delegates Hong Kou Education Bureau, together with Prison Administration Bureau to organize a general examination for inmates with education level below junior high school. Every prison should carry out the enrolment for examination, the setting up of examination room, invigilation of the examination, maintain the order of the examination room, and eliminate violation of rules and cheating during examination, so as to ensure that the examination is carried out orderly.

  Inmates who pass the examination are issued with ゞliteracy certificate〃and various graduation certificates that are uniformly produced under the supervision of the Shanghai education committee.

  Higher education self study examination is uniformly organized by the Prison Administration Bureau, and conducted in the examination room specifically set up in the prison, to enable inmates to take part in the Shanghai higher education self-study examination.

  Rule 9 (Teacher’s Qualification, Research and Teaching Materials)

  In addition to implementing socialized cultural education, prison should be equipped with teachers. Teachers for cultural education can be selected from inmates with higher education levels, and who have undergone training in teaching. Teachers should set up a ゞteaching and training status record card〃. The prison should organize and establish at least one week training for teachers before the beginning of each semester.

  The prison should set up staff room according to the subjects. The director of staff room should be assumed by police officer. Staff room should carry out at least one research activities per month; organize teachers to hold more than one open emulate classes every semester, and organize teachers to discuss and appraise the open emulate classes.

  Illiteracy elimination, elementary school and junior high school education for inmates all use Shanghai prisons special textbooks uniformly.

  Chapter 3 Administration of Cultural Education

  Rule 10 (Teaching Arranging)

  Cultural education should establish teacher materials such asゞSchool Calendar〃、ゞCourse Timetable〃,etc. Before the beginning of every academic year, a brief teaching summary should be carried out. Every semester, the staff room should set up course schedule for every semester and courseゞSyllabus〃and periodically monitor the teaching progress. Teaching plan and summary should be submitted to the Education Reform Department of the Prison Administration Bureau for record purpose.

  Rule 11 (Statistical Analysis)

  Prison should prepare statistical report forms base on requirements and on schedule, establishes the system of statistically analyzing the status of education and receiving certificates, and to submit the cultural education statistical report forms to the Education Reform Department of the Prison Administration Bureau at the end of June and December of every year.

  Rule 12 (Teaching Guarantee)

  Prison should strengthen it’s relation with the education department of the local district (4 prisons in Wan Nan, Su Bei and Bao Shan districts), communicates regularly and to strive for support.

  Prison should try it’s best to improve the conditions for running a school, regulate study location, ascertain classroom for cultural teaching, and to gather necessary teaching appliances such as desks and chairs, etc.

  Cultural education expenses for inmates with education level below junior high school should be listed and be reimbursed out of the education reform budget, and not allowed to be collected from inmates or their relatives.

  Chapter 4 Supplementary Articles

  Rule 13 (Rights of interpretation)The interpretation of this regulation is the responsibility of the Shanghai Prison Administration Bureau.

  Rule 14 (Effective period)The effective period of this regulation is 5 years, from 2015 November 1st to 2020 October 31st. The original ゞImplementation Opinions Relating to the Work of Cultural Education for Inmates〃that was implemented on 2010 October 18th (Shanghai Prison Department Educational Reform _2010ヽNo.36)is hereby repealed.
